Terms of Service

These terms govern your use of Utenat ("the Service"), operated by Clever Living AS ("we", "us"). By creating an account you agree to these terms.

1. Parties

These terms constitute an agreement between you as the user ("the Customer") and Clever Living AS, org. no. 920 793 657, Sandbakkveien 15, 2020 Skedsmokorset, Norway ("the Provider"). The service provided is Utenat, a digital learning platform available at utenat.no.

2. Who Can Use the Service

You must be at least 16 years old to use Utenat. By registering, you confirm that you meet this age requirement. If you are under 18, you confirm that you have parental consent.

3. Your Account

You are responsible for keeping your login credentials secure. You are responsible for all activity on your account. Notify us immediately at support@utenat.no if you suspect unauthorized use.

4. Acceptable Use

You agree not to:

  • Use the service for illegal purposes
  • Upload content that is harmful, threatening, or abusive
  • Attempt to disrupt or overload the service's infrastructure
  • Attempt to reverse-engineer or copy the service's software
  • Share your account with others
  • Use automated tools to scrape content from the service
  • Use AI-generated content as your own work in violation of your institution's academic integrity policies

5. Content and Ownership

  • You own the content you create — You retain all rights to notes, documents, and other content you upload or create in Utenat.
  • You grant us a limited license to store, process, and display your content in connection with providing the service. We do not use your content to train AI models.
  • AI-generated content (session summaries, flashcards, quizzes) is derived from your source content. You have the right to use this generated content.
  • We reserve the right to remove content that violates these terms.

6. Subscription and Payment

  • Utenat offers Free, Standard (149 NOK/mo), and Premium (259 NOK/mo) plans. Prices may change with 30 days' notice.
  • Paid subscriptions are billed monthly. Payment is processed via Stripe (credit card) or Vipps MobilePay.
  • You can cancel your subscription at any time. You retain access to paid features until the end of the current billing period.
  • There is no commitment period. The subscription runs month-to-month and can be cancelled at any time at no extra cost.
  • You can upgrade or downgrade your subscription at any time via Settings. When upgrading, the new plan takes effect immediately and you pay the difference for the remaining days. When downgrading, the new plan takes effect at the next billing period.

7. Delivery

The service is delivered digitally. Upon creating an account, you get immediate access to the free plan. When purchasing a Standard or Premium subscription, access to paid features is activated immediately after payment is approved. The service is available via your browser at utenat.no.

8. Right of Withdrawal

In accordance with the Norwegian Right of Withdrawal Act (Angrerettloven), you have the right to withdraw from your purchase within 14 days of the first subscription payment, without giving a reason.

To exercise your right of withdrawal, send an email to support@utenat.no with the subject "Withdrawal" and include the name and email address associated with your account.

Upon approved withdrawal, the full amount will be refunded to the original payment method within 14 days.

Note: If you have started using paid features during the withdrawal period, you may be asked to pay for the actual usage. Continued use after the 14-day period is considered a waiver of the right of withdrawal.

You may also use the Norwegian Consumer Council's standard withdrawal form.

9. Returns

Utenat is a digital service and no physical goods are delivered. Returns are therefore not applicable. See section 8 on the right of withdrawal for information about refunds.

10. Complaint Handling

If you experience defects or issues with the service, you may file a complaint. We follow the Norwegian Consumer Purchase Act.

  • Send your complaint to support@utenat.no with a description of the issue. We will respond within 5 business days.
  • For valid complaints, we will offer correction of the issue, a price reduction, or a refund, as appropriate.

11. Availability and Changes

We aim for 99.9% uptime, but cannot guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue features with reasonable notice. For significant changes, we will give at least 30 days' notice.

12. Limitation of Liability

The service is provided "as is". We are not liable for indirect losses, data loss beyond what is caused by our gross negligence, or results from the use of AI-generated content. Our total liability is limited to the amount you have paid for the service in the last 12 months.

13. Termination

You can delete your account at any time via Settings. We may suspend or terminate your account for violation of these terms, with reasonable notice unless the breach is severe. Upon termination, you have 30 days to export your data.

14. Disputes and Conflict Resolution

These terms are governed by Norwegian law. Any disputes shall first be attempted resolved through dialogue with us. If this does not succeed, you may bring the matter to the Norwegian Consumer Council (forbrukerradet.no) for mediation. If mediation is unsuccessful, the dispute may be brought before Oslo District Court.

15. Changes to Terms

We may update these terms. For significant changes, we will notify you at least 30 days in advance by email. Continued use after notification constitutes acceptance of the new terms.
